At the regularly scheduled meeting of the Fire and Police Pension Fund Board of Directors held on the 17th day of November 2016, President Craig Joel presided. The meeting was held at the Pension Office, 6009 John Douglass Drive, Chattanooga, TN 37421.
The meeting convened at 0908 hours with board members Craig Joel, Kelly Simmons, Mark Coffman, Charlie Thomason, Tommy Meeks, and Vickie Haley. Attorney Bill Robinson was also present.
Motion by Mark Coffman and seconded by Kelly Simmons to approve the minutes of the November 03, 2016 meeting. Motion carried unanimously.
Attorney Bill Robinson reported that on November 3, 2011, the 6th Circuit Court of Appeals ruled in the Frazier case that the annual Cost-of-Living Adjustment (COLA) is not a vested benefit and does not accrue until the COLA is applied to the benefit. He reminded the Board that the Dodd case’s oral argument regarding the vesting of future benefits by active Member’s surviving spouse is scheduled for November 30, 2016 in the 6th Circuit Court of Appeals.
Janet Neighbors, CPA of LBMC presented the Compilation and Agreed Upon Procedures reports for the Fund.
Motion by Mark Coffman and seconded by Vickie Haley to approve the following membership items:

- Police Sergeant Jon Chad Sullivan, retiring with 25 years of service, adjusted for 100% J&S Option B (Shelley L. Sullivan), effective 12/01/2016, adjusted participation date of 11/13/1991 (2-411, 2-418)
REFUND CONTRIBUTIONS:
- Former Police Officer Gregory Tate, terminated 11/16/2016, participation date of 04/18/2014 (2-413)
- Former Police Officer Albert Joy, terminated 11/07/2016, participation date of 04/18/2014 (2-413)
- Former Police Officer Nicholas Payne, terminated 10/30/2016, participation date of 09/18/2015 (2-413)
Motion carried unanimously.
The Board reviewed the bills paid since the last meeting.
The staff noted two membership items that had been omitted in previous meeting minutes:
Motion by Mark Coffman and seconded by Charlie Thomason to amend the 11/05/2015 minutes under the heading Add To The Rolls: Betty L. Calloway, surviving spouse of Retired Police Captain Paul R. Calloway, effective 11/01/2015 (2-411). Motion carried unanimously.
Motion by Mark Coffman and seconded by Kelly Simmons to amend the 07/01/2010 meeting minutes to include: Motion by Corliss Cooper and seconded by Scott Fulgham under CCC 2-411 to add to the rolls Police Officer James E. Brock with 25 years of service, effective 06/23/2010. Motion carried unanimously.
Motion by Kelly Simmons and seconded by Mark Coffman to adjourn at 0953 hours. Motion carried unanimously.
