June 19, 2014 Minutes

At the regularly scheduled meeting of the Fire and Police Pension Fund held on the 19th day of June 2014, Vice President Shawn O’Kelley presided. The meeting was held at the Pension Office, 6009 John Douglass Drive, Chattanooga, TN 37421.

The meeting convened at 0913 hours with board members Shawn O’Kelley, Phillip McClain, Brent Goldberg, Jerome Halbert, and Craig Joel. Mark Coffman joined the meeting at 0930 hours. Attorney Bill Robinson was also present. Less Lee and Chris Willmore were excused absences.

Motion by Craig Joel and seconded by Jerome Halbert to approve the minutes from the June 5, 2014 meeting. Motion carried unanimously.

Motion by Brent Goldberg and seconded by Phillip McClain to approve the following membership changes:

REMOVE FROM THE ROLLS:

Casey S. Austin, surviving spouse of Firefighter John L. Austin, effective 06/30/2014, died 06/11/2014 (2-411)

ADD TO THE ROLLS:

Fire Lieutenant Shawn N. Shipley with 28 years of service, reduced to a 25 year pension and a 36 month DROP, effective 06/28/2014, adjusted participation date of 03/27/1986 (2-411 and 2-422)

AMENDMENT: Master Patrol Officer Edwin D. Duke, effective May 15, 2014, with 25 years of service and a 10-month DROP reduced for 50% J&S (Angela Duke). Retirement eligibility date of July 15, 2013. (2-411, 2-418, 2-423). (Originally elected 75% J&S)

REFUND CONTRIBUTIONS:

Former Fire Lieutenant Michael Dewayne Davenport, pension participation date of 11/19/1998, terminated 05/02/2014 (2-415)

DISABILITY HEARINGS:

Michael Dewayne Davenport’s application for Job Related Disability denied on 06/05/2014

The motion carried unanimously.

Attorney Bill Robinson updated the Board on the Walden lawsuit (hearing scheduled for 07/02/2014) and a legal inquiry from Attorney Gerry Tidwell, who represents former Police Chief Bobby Dodd, regarding the modification of the subsidized Joint & Survivor benefit that was removed for members not retirement eligible by 01/01/2013.

The Board reviewed the FY2015 Fund operating budget. Motion by Craig Joel and seconded by Phillip McClain to approve the budget pending recommendations from the personnel committee. Motion carried unanimously.

Motion by Phillip McClain and seconded by Jerome Halbert to pay the bills. Motion carried unanimously.

Motion by Mark Coffman and seconded by Craig Joel to adjourn at 1008 hours. Motion carried unanimously.

Note: Annual Trustees Meeting is scheduled for September 17-18, 2015

Note: Sarah Fuller was rehired as a Police Officer effective 06/13/2014. Officer Fuller has elected to not repay her previously withdrawn contributions and will be treated as new hire for pension purposes.
