December 4, 2014 Minutes

At the regularly scheduled meeting of the Fire and Police Pension Fund held on the 4th day of December 2014, President Chris Willmore presided. The meeting was held at the Pension Office, 6009 John Douglass Drive, Chattanooga, TN 37421.

The meeting convened at 0910 hours with board members Chris Willmore, Craig Joel, Mark Coffman, Jerome Halbert, Phillip McClain, and Less Lee. Attorney Bill Robinson was also present. Brent Goldberg and Kelly Simmons had excused absences.

Motion by Jerome Halbert and seconded by Craig Joel to approve the minutes from the November 20, 2014 meeting. Motion carried unanimously.

Attorney Robinson stated that the Board has now been served with a lawsuit filed by former Chief of Police Bobby Dodd against the City and the Fund. Mr. Robinson gave an update to the Board on the lawsuit’s current status. The Board discussed the notification given to Firefighters and Police Officers on the modification of the Surviving Spouse benefit that is the focus of the lawsuit. The Board voted to recommend to City Council an amendment to the Surviving Spouse benefit on November 15, 2012. The Board was notified in the December 6, 2012 meeting that City Council had passed the first reading of the amendment on December 4, 2012. Notice of the recommended modification to the Surviving Spouse benefit was sent, with high importance, to active Firefighters and Police Officers via the City’s sworn email distribution list on November 20, 2012 and on November 21, 2012 that explained the modification.

Motion by Craig Joel and seconded by Jerome Halbert to approve the following membership changes:

      • Police Officer Ryan F. Harris, terminates 12/08/2014, pension participation date of 01/21/2011 (2/413)

Motion carried unanimously.

Motion by Phillip McClain and seconded by Jerome Halbert to adjourn at 0940 hours. Motion carried unanimously.
